Dishtrict is operated by Dishtrict LLC, a Virginia limited liability company (“Dishtrict,” “we,” “us,” or “our”). These Terms of Service (the “Terms”) are the agreement between you and Dishtrict when you use the app, the website, and everything we offer (the “Service”). By creating an account or using the Service, you agree to these Terms. Please read them alongside our Privacy Policy and Community Guidelines, which are part of these Terms. If you don't agree, please don't use the Service.
You must be at least 15 years oldto use Dishtrict, and old enough to form a binding contract where you live. When you sign up you confirm you meet that minimum age and agree to these Terms, the Privacy Policy, and the Community Guidelines. During the invite-only beta, you also need a valid invite code. If you use the Service on behalf of a business, you confirm you're authorized to accept these Terms for it.
You're responsible for your account and for keeping your password safe, and you're responsible for everything that happens under it. Don't share your login, impersonate anyone, or create accounts to abuse the Service. Confirm your email so we know it's really you. Tell us promptly if you think someone has used your account without permission.
You own what you create. The ratings, scores, taste tags, reviews, photos, and videos you post (“Your Content”) belong to you. We don't claim ownership of them.
So that the Service can actually work, you give Dishtrict a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, adapt (for example, resize or crop for layout), publish, publicly display, and distribute Your Content in connection with operating, improving, and promoting the Service — such as showing your photo of a dish on that dish's page, in the reel, in search results, or in a share-preview image. This license lasts only as long as Your Content is on Dishtrict; when you delete Your Content or your account, the license ends for future use, except for content others have already re-shared, and copies that remain in backups for a limited time before being overwritten. You confirm you have the rights to everything you post and that it doesn't break the law or these Terms. Aside from this license, we make no commercial use of your photos and we don't sell them.
Content on Dishtrict belongs to the person who posted it or to Dishtrict. You may not copy, download, screenshot, repost, sell, or share someone else's photos, videos, reviews, or ratings as your own , or use them anywhere else, without that person's permission. Posting content you don't have the rights to — including other people's photos or reviews taken from Dishtrict or anywhere else — is not allowed and can get your account removed.
The information on Dishtrict — including restaurant listings, hours, addresses, neighborhoods, our scores and rankings, reviews, taste tags, and the photos and videos members post — is provided for your personal, non-commercial use of the Service. It is not free for anyone to take. Except with our prior written permission, you agree not to:
We reserve every right in our content and data that we don't expressly grant here, and we may take technical and legal steps — including blocking access and seeking an injunction — to stop unauthorized copying or scraping.
The Service itself — the Dishtrict name and logo, the software and design, the curated food catalog, and our aggregated scores, rankings, and the way listings are compiled and organized (the “Dishtrict Content”) — is owned by Dishtrict LLC and protected by intellectual-property laws. We give you a limited, personal, non-transferable, revocable license to use the Service as intended. That's the only license we grant; you get no other rights in the Dishtrict name or the Dishtrict Content.
We respect intellectual-property rights and expect you to do the same. If you believe content on Dishtrict infringes your copyright, email us at dishtrict88@gmail.com with: (1) your contact information; (2) a description of the work and the infringing content, with enough detail to find it (a link is best); (3) a statement that you have a good-faith belief the use isn't authorized; (4) a statement, under penalty of perjury, that your notice is accurate and you're the owner or authorized to act for them; and (5) your signature (typed is fine). We remove infringing content and, where appropriate, terminate repeat infringers.
Using Dishtrict means following our Community Guidelines. In short:
We review reports and disputes, and our decision is final. We can remove content, and we can suspend or permanently delete accountsthat break these rules — and we'll decide what counts as a break. Content that's taken down for a violation is removed permanently and is not restored. Accounts used for spam, fake or paid ratings, scraping, or other abuse may be deleted without notice; when we do, we remove that account's ratings, photos, videos, and information, and we may block the IP address(es) associated with the abuse to keep it from coming back.
Scores and reviews on Dishtrict are people's personal opinions, not statements of fact. Listings, hours, and details can be wrong or out of date. Use your own judgment.
Dishtrict is an early beta. We work hard to keep it running, but to the fullest extent allowed by law the Service is provided “as is” and “as available,”without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, secure, or error-free, or that any listing, rating, or detail is accurate.
To the fullest extent allowed by law, Dishtrict LLC and its members, managers, officers, employees, and agents won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, data, or goodwill, arising out of or relating to your use of the Service — even if we've been told such damages are possible. To the extent we're ever found liable, our total liability is limited to the greater of $100 or the amount you paid us (if anything) in the 12 months before the claim. Because Dishtrict is an LLC, its obligations are the company's alone: no member, manager, officer, or employee is personally liable for them. Some places don't allow these limits, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Dishtrict LLC and its members, managers, officers, employees, and agents from any claims, damages, losses, and reasonable legal costs arising out of content you post, your use of the Service, or your breach of these Terms or the law.
Please read this carefully — it affects your legal rights. Except for the exceptions below, you and Dishtrict agree that any dispute arising out of or relating to these Terms or your use of Dishtrict will be resolved by final and binding individual arbitration, rather than in court. There is no judge or jury in arbitration, and review of an arbitrator's decision is limited.
Class-action waiver. You and Dishtrict agree to bring claims against each other only in an individualcapacity — not as a plaintiff or member in any class, collective, consolidated, or representative action. The arbitrator may not combine more than one person's claims or preside over any class proceeding.
Exceptions. Either of us may still (1) bring a qualifying individual claim in small-claims court, and (2) ask a court for an injunction or similar relief to protect intellectual property or stop misuse of the Service. Nothing here waives any right that can't be waived under the law that applies to you.
Your right to opt out. You can opt out of this arbitration and class-action-waiver agreement within 30 days of first accepting these Terms by emailing dishtrict88@gmail.com with your username and the words “arbitration opt-out.” Opting out won't affect any other part of these Terms.
Where this doesn't apply. If you live somewhere that doesn't allow mandatory pre-dispute arbitration or class-action waivers for consumers, this section applies only to the extent the law protecting you permits.
These Terms and any dispute are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules, except where the law where you live requires otherwise. Where a dispute may be heard in court rather than arbitration, it will be brought in the state or federal courts located in Virginia, and you and Dishtrict consent to their jurisdiction — subject to any mandatory consumer protections in your home location.
You can stop using Dishtrict any time and delete your account yourself from Settings → Danger zone → Delete my account. Deleting is permanent: it erases your profile and everything you've posted, and it can't be undone. We may also suspend or end access for anyone who breaks these Terms or misuses the Service. Sections that by their nature should survive — content licenses already granted, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — survive after your use ends.
We may update these Terms as Dishtrict grows. Everyday changes will be reasonable and take effect when we post them (we'll update the date above). If we make a significantchange, we'll ask you to agree again before you keep using the app — if you don't agree to the new Terms, you can stop using Dishtrict and delete your account.
